REQUEST FOR INVESTIGATION INTO POSSIBLE WAR CRIMES ARISING FROM THE ATTACK ON THE SHAJAREH TAYYEBEH SCHOOL IN MINAB, IRAN

 TO THE OFFICE OF THE PROSECUTOR

INTERNATIONAL CRIMINAL COURT

ARTICLE 15 COMMUNICATION

SUBJECT: REQUEST FOR INVESTIGATION INTO POSSIBLE WAR CRIMES ARISING FROM THE ATTACK ON THE SHAJAREH TAYYEBEH SCHOOL IN MINAB, IRAN

28 FEBRUARY 2026

I respectfully submit this communication to the Office of the Prosecutor of the International Criminal Court pursuant to Article 15 of the Rome Statute.

I request that the Office investigate the circumstances surrounding the attack on the Shajareh Tayyebeh school in Minab, Hormozgan Province, Iran, on 28 February 2026, in which a large number of schoolchildren and other civilians were killed.

I further request an investigation into the possible individual criminal responsibility of Donald J. Trump, President of the United States; JD Vance, Vice President of the United States; Pete Hegseth, Secretary of Defense of the United States; and any other civilian or military officials who may have ordered, authorized, planned, facilitated, executed, or otherwise contributed to the alleged crimes.

I. FACTS

On 28 February 2026, during military operations against Iran, an attack struck the Shajareh Tayyebeh school in Minab.

The facility was an educational institution attended by children. The attack caused a mass loss of civilian life.

Information available to the complainant has reported that 128 girls were killed. Other sources have reported different casualty figures. I therefore request that an independent investigation establish the exact number and identities of all persons killed and injured.

The large number of children reportedly killed in an educational institution makes an independent international investigation imperative.

II. POSSIBLE WAR CRIMES

The circumstances of the attack raise serious questions under international humanitarian law.

The investigation should determine:

  1. Whether the school was a civilian object.

  2. Whether any military objective was located at or near the school.

  3. What military objective the attacking forces intended to strike.

  4. Whether the attacking forces knew that the location was an educational institution.

  5. Whether they knew that children were present.

  6. Who selected the target.

  7. Who authorized the attack.

  8. What weapons were used.

  9. What military unit conducted the attack.

  10. What intelligence was available before the attack.

  11. What precautions were taken to protect civilians.

  12. Whether the anticipated civilian harm was excessive in relation to the concrete and direct military advantage anticipate
